6. Discussion and Background
The City currently has a four-year agreement with Lyons Security Services Inc. (Lyons), a private security firm, to patrol city parks during non-operating hours. This strategy has proven effective in increasing park safety by reducing illegal activity such as drug use and vandalism, as well as ensuring compliance with park closure hours. A security presence acts as a deterrent to these illicit behaviors, and in most cases, Lyons is successful in gaining public compliance with city ordinances. Lyons works closely with the Orange Police Department (OPD) in cases where further enforcement is required.
The City Council approved the current four-year Agreement with Lyons in May of 2020 to provide security patrols in our parks during park closure hours. In May of 2021, the City Manager executed the First Amendment to the Agreement, adding the Old Towne West Metrolink Parking Structure to the service area and dedicating hours for patrol of the parking structure. The First Amendment increased the compensation by $12,000. In February 2022, the City Council approved the Second Amendment to the Agreement, allowing for increased park patrol services at El Camino Real Park during daytime park hours. The Second Amendment increased the contract authority by $40,000. The funding for the Second Amendment was provided by grant funding from the North Orange County Public Safety Collaborative.
In Spring of 2022, the Third and Fourth Amendments were added to the Agreement, in support of the City’s plan to provide onsite security services for its unhoused community during operational hours at the HUB Resource Center (HRC) located at 517 W. Struck Avenue. The additional amendments added an additional $271,352 onto the agreement. The HRC is currently exploring alternative security options at no cost to the City’s General Fund.
Discussion
The City is committed to continuing to provide security services for after-hours park patrol. The current service level for after-hours park patrol is two guards for eight hours per evening, seven days per week. As the contract term has progressed, the hourly rate for guard services has increased each year. Additionally, the current agreement capped the total amount allowable for regular after-hours park patrol at $110,000 annually, separate from the additional El Camino Real Park daytime security service.
In order to continue providing security services, staff is recommending that the City Council approve the Fifth Amendment to the Agreement with Lyons in the amount of $30,776.82 to continue the after-hours park patrol program at the current service level through the end of the contract period. While the park patrol program is funded through the General Fund (100), staff is not requesting an additional General Fund appropriation for the after-hours park patrol program. The current Community Services General Fund (100) operating budget will absorb as much of the $30,776.82 as the budget will allow.
The current security service Agreement expires on June 30, 2024. Staff is currently preparing to bring forward a recommendation to award a new four-year agreement at the June 25 City Council meeting pending adoption of the Fiscal Year 2024-2025 budget.
