6. Discussion and Background
The General Municipal Election to elect members of the Orange City Council is held in November of even numbered years. The November 5, 2024, General Election, held in conjunction with the Statewide General Election, shall be for the election of a Mayor for the full term of two years; three Councilmember seats in Districts 2, 3, and 5, all for a full term of four years; a City Clerk for the full term of four years; and a City Treasurer for the full term of four years.
Prior to June 17, 2024, the City Council must adopt a resolution calling and giving notice of the November 5, 2024, General Municipal Election, request consolidation with the Statewide General Election, and set regulations pertaining to candidate statements.
The candidate filing period for the November 5, 2024, election will open at 7:30 a.m. on Monday, July 15, 2024, and close at 5:30 p.m. on Friday, August 9, 2024. If an incumbent does not file by August 9, 2024, the nomination period is extended to Wednesday, August 14, 2024, for non-incumbents only.
Resolution No. 11543 establishes regulations for candidates for elective office pertaining to candidate statements submitted to the voters. Only candidates wishing to submit a candidate statement will be charged to cover the cost of printing the statement in the voter information guide. The statement may include the name, age, and occupation of the candidate and a brief description of no more than 200 words of the candidate’s education and qualifications.
In addition, at the March 12, 2024, meeting, City Council directed staff to place a City measure on the November ballot to permit the sale, possession, and use of “safe and sane” fireworks in the City of Orange. Resolution No. 11545 orders the submission of such a ballot measure to the electors; and Resolution Nos. 11542 and 11546 authorize the filing of arguments and rebuttal arguments and direct the City Attorney to prepare an impartial analysis of the measure. Pursuant to Elections Code § 9282, when a measure is placed on the ballot by the legislative body, it may authorize certain persons to author the argument for or against any city measure. Therefore, the City Council may authorize itself or any subset to be signatories to the argument. The designated Councilmembers should prepare the arguments on their personal time and submit them directly to the City Clerk without further action or involvement by the City as public resources cannot be used for political activity.
Adoption of the attached resolutions is required to initiate the process for conducting the City’s General Municipal Election and consolidate with the Statewide General Election to be held on the same date.
It should be noted that ballot measures may still be placed on the ballot by separate resolution, provided the resolution calling for the measure to be placed on the ballot is adopted by City Council no later than June 30, 2024, and filed with the Orange County Board of Supervisors and the Orange County Registrar of Voters no later than July 19, 2024.
