6.                     Discussion and Background

State of California Budget

On Friday, May 10, 2024, Governor Newsom released the 2024-2025 State Budget May Revise (May Revise). The May Revise incorporates changes to Governor Newsom’s proposed January 2024 budget to reflect tax returns as well as changes to inflationary pressures and federal monetary policies. Governor Newsom estimates a $27.6 billion deficit with ongoing deficits of around $30 billion per year beginning in 2025.  Attached for reference is an overview of the May Revise.

Assembly Bill 2309

California Government Code Section 41803.5 authorizes general and charter law city attorneys to prosecute state misdemeanors with district attorney consent. As currently written, Assembly Bill (AB) 2309 allows local legislative bodies to pass an ordinance authorizing city attorneys to prosecute state misdemeanors without prior district attorney approval.

In recognizing that cities are best suited to understand the public safety challenges within their communities, Resolution No. 11549 memorializes the Orange City Council’s support for AB 2309. Should the City Council adopt Resolution No.11549, staff will continue to monitor this bill as it moves through the legislative process.
