The City engaged HF&H Consultants, LLC to support SB 1383 compliance, including program development and regulatory audits. As requirements and complexity increased, the City expanded HF&H’s scope and now recommends a $60,000 amendment to continue essential consulting services and ensure ongoing support and compliance with State regulations.

6.                     Discussion and Background

The passage of Senate Bill 1383 established statewide methane-reduction targets and requires local jurisdictions to implement comprehensive organic-waste diversion regulations. To adhere to these requirements, jurisdictions must monitor, record, inspect, address contamination, educate the public, track procurement activities, and document enforcement efforts.

On September 17, 2025, the City entered into an agreement with HF&H Consultants, LLC (HF&H) for $30,000 to prepare for a CalRecycle Jurisdictional Annual Compliance Evaluation review. As the complexity of the documentation and regulatory requirements became apparent, it was clear that additional support was necessary. Under this amendment, HF&H will assist the City with program implementation, preparation of compliance documentation, development of recordkeeping systems, and preparation for CalRecycle audits. Their expertise has helped ensure the City meets State mandate requirements and significantly reduces the risk of enforcement actions and penalties.

As SB 1383 regulations continue to evolve, the City faces ongoing obligations to monitor, report, administer ordinances, and adapt programs. The technical and ever-changing regulatory landscape requires continuous consulting support. HF&H remains essential to maintaining effective, adaptable organics compliance and fulfilling State reporting requirements.

To sustain proactive compliance and allow HF&H to continue providing critical support, staff recommends approving a First Amendment in the amount of $60,000, which will bring the total agreement amount to $90,000. This support includes ongoing SB 1383 monitoring, annual reporting and recordkeeping, program implementation guidance, regulatory advice, franchise fee valuation, and preparation for future CalRecycle inspections and audits.
