6. Discussion and Background
Unlawful offenses involving alcohol and drugs, pursuant to the California Vehicle Code, may require the collection of evidence samples. In accordance with Vehicle Code 23158, evidentiary samples must be collected by qualified personnel including certified phlebotomy technicians, licensed physicians, nurses, or other authorized individuals.
Once collected, evidentiary samples are submitted to the Orange County Crime Lab (OCCL) for analysis. The withdrawal, handling, and preservation of evidentiary samples must comply with strict procedural standards as outlined in the Orange Police Department Policy Manual, Policy No. 505.
Since 1989, the Orange Police Department has contracted with California Forensic Phlebotomy, Inc. (CFP) to provide evidentiary blood collection services. CFP provides trained medical personnel to perform blood draws, provide chain of custody, transports evidence to OCCL, and provides court testimony as needed. CFP operates 24 hours per day, seven days per week, and serves other Orange County law enforcement agencies, including the Sheriff’s Department and California Highway Patrol.
The proposed agreement term spans two fiscal years, commencing July 1, 2026, and terminating June 30, 2028. For Fiscal Years 2026-2027 and 2027-2028, the current per-sample service rate will remain unchanged at $164 per sample. Services will be procured through a Cooperative Agreement between CFP and the Sheriff-Coroner under Contract No. MA-060-26010704.
Based on CFP’s high level of service and reliability, the Police Department recommends the continuation of evidentiary blood collection services at a cost of $82,000 annually, for a total contract amount of $164,000 over the two-year term.
