6.                     Discussion and Background

Currently there are a total of 54 light poles providing area and pathway lighting throughout Grijalva Park. The existing light poles are composed of thin gauge steel poles mounted on reinforced concrete foundations at ground level. Many of the existing light poles have failed and have been removed due to corrosion at the base of the poles caused by weather and/or standing irrigation water at the base.

As part of the Area Lighting Replacement at Grijalva Park Capital Improvement Project (20477), the City contracted with Lin Consulting, Inc. (Lin) in 2022 to provide design services and a contract was awarded to Delta Electric, LLC (Delta) in November 2023 in the amount of $621,390 to complete the replacement of the lights.

In May 2024, Delta submitted a written request to the City to release the company of their contract obligations due to outside challenges that impacted their ability  to fulfill the terms outlined in the contract. Delta had yet to complete the work and furnish the labor, materials, tools, and equipment necessary to complete this project. In June 2024, the City entered into an Agreement and Release of Claims with Delta, terminating the contract.

Staff issued a new request for bids to complete this project (RFB No. 24-25.06) in August 2024. The City received 6 bids in September 2024:

1.                     Bear Electrical Solution, LLC, Alviso, CA                                                                                    $630,000.00

2.                     Metrocell Construction, Inc., Ontario, CA                                                                                    $685,000.00

3.                     Oppenheimer National, San Juan Capistrano, CA                                          $698,000.00

4.                     Mel Smith Electric, Inc., Stanton, CA                                                                                    $734,000.00

5.                     Elecnor Belco Electric, Inc., Chino, CA                                                                                    $779,000.00

6.                     RMF Contracting, Inc., Anaheim, CA                                                                                    $779,276.00

The lowest responsive and responsible bid is from Bear Electrical Solutions, LLC, (Bear) for $630,000. Staff verified the qualifications of the vendor with references provided for similar projects and received positive responses. Bear’s main office is located in northern California in Alviso, but the servicing office for this project is located in Anaheim.

The starting fund balance for Fiscal Year 2024-25 (FY25) for this project is $634,646, which includes $371,960 in Park Acquisition (Infill) (510) funding and $262,686 in the State’s Per Capita Allocation program funded through Prop 68. Following approval of the proposed contract, the project will require an additional appropriation of $58,354 to complete the project.

All work will be done with the intent of minimizing disruption to regular park programming or rentals. It may be necessary to restrict access to one or more facilities for specific dates, times, or durations for safety reasons. Signage will be placed at appropriate locations to inform the public of any closures. Work start date and completion will be contingent upon weather conditions.

7.                     ENVIRONMENTAL REVIEW

Categorical Exemption:  The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15302 (Class 2 - Replacement or Reconstruction) because the project replaces existing light poles with new light poles in the same locations. The new structures will have substantially the same purpose and capacity as the existing light pole. No public review is required.
