Award of a contract for the construction of structural improvements to the Dog Park at Yorba Park. The scope of work for the Capital Improvement Project, Yorba Dog Park Improvements (20521) includes the removal of existing decomposed granite, turf, fencing and posts, modifying existing grade and installing new concrete, paver entry, seating areas, new chain link fencing, and turf.

1. Approve the agreement with R.E Chaffee Construction, Inc. in the amount of $233,200 for the Yorba Dog Park Improvements project (20521); and authorize the Mayor and City Clerk to execute on behalf of the City.
2. Authorize the appropriation of $115,000 from the Park Acquisition (Infill) (510) unreserved fund balance to account 510.7021.56020.20521 - CIP - Building and Improvements.
3. Find that the proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15331 (Existing Facilities)

Upon approval of this appropriation, the estimated Park Acquisition (510) fund balance on June 30, 2025 will be $8,962,992.

6. Discussion and Background
The City owns and maintains the Dog Park at Yorba Park. The dog park currently uses a system of decomposed granite (DG) entry paths. Compaction of the DG has become difficult to maintain due to foot traffic in and out of the dog park areas, causing the DG to become loose and uneven, creating tripping hazards. The loose DG also enters the drainage system, causing blockages and reoccurring maintenance issues. At the request of the Orange Dog Park Association, staff evaluated options for improving these dog park entry areas.
The Yorba Dog Park Improvements project (20521) was approved as a part of the Fiscal Year 2024-25 CIP. The scope of work includes improvements to entry areas by replacing the DG with new hardscape (concrete pavers) and a retaining wall to create safer entryway access. In addition, the project will also include a new access gate, irrigation, and related turf repairs. These improvements will reduce overall ongoing maintenance costs.
The City contracted with RHA Landscape Architects-Planners, Inc. (RHA) to design a plan and construction documents. A request for bids (RFB No. 24-25.12) was issued in December 2024. The City received seven bids:

The lowest responsive and responsible bid received was from Kormex Construction, Inc. (Kormex). Shortly after receiving the bids, Kormex submitted a letter to the City Clerk stating that a clerical error was made on their bid submittal and requested to be relieved of their bid. The City determined that the conditions required for bid withdrawal had been met and accepted Kormex’s request to withdraw its submission.
As required by Public Contract Code, staff then proceeded on to the second lowest responsive and responsible bid from R.E Chaffee Construction, Inc., (Chaffee) in an amount of $212,000. Staff verified the qualifications of the vendor with references provided for similar projects and received positive responses. The total amount for this proposed contract is $233,200, which includes the base bid amount and a 10% contingency of $21,200.
To date, $125,000 in Park Acquisition (Infill) (510) funding has been approved for this project. Approval of the proposed contract and contingency as recommended will require a supplemental appropriation of $115,000 from the Park Acquisition (Infill) (510) unreserved fund balance to complete the project.
Work start date and completion will be contingent upon weather conditions. Information regarding closures to the dog park during construction will be shared on social media, at the park, and with the Orange Dog Park Association.
7. ENVIRONMENTAL REVIEW
The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15331 (Existing Facilities) because the project only involves maintenance activities and partial renovation of the current park. No public review is required.
