In October 2023, the City Council awarded an agreement to Moore Iacofano Goltsman, Incorporated, dba MIG, Inc. for design services for the Capital Improvement Project, New Park in West Orange (20513). This project was also awarded partial federal funding through the Department of Housing and Urban Development, therefore, environmental clearance under the National Environmental Policy Act must be completed. The amendment to the agreement with Moore Iacofano Goltsman, Incorporated, will allow the contractor to provide these services. The cost of the amendment is $34,595, bringing the total agreement not-to-exceed amount to $280,558.30.

6. Discussion and Background
In October 2023, the City Council awarded a contract to Moore Iacofano Goltsman, Incorporated (MIG) for design services for the Capital Improvement Project, New Park in West Orange (20513).
A conceptual site plan was completed in Spring 2024, including completing the California Environmental Quality Act (CEQA) Notice of Exemption (NOE). As part of the Fiscal Year 2024-2025 (FY25) Capital Improvement Plan, the City Council approved $3,000,000 of Redevelopment Agency funds towards the construction of the park.
In Spring 2024, the City also received notification that the project was awarded $850,000 in federal funding through the Department of Housing and Urban Development (HUD). As such, the City is now required to complete an additional environmental clearance under the National Environmental Policy Act (NEPA).
The environmental clearance under NEPA will include preparation of an Environmental Assessment (EA) specific to NEPA and HUD’S NEPA guidelines and requirements. The impact analysis conducted will identify all potential environmental impacts and the conditions that would change as a result of the project; analyze and evaluate all impacts to determine the significance of their effects on the human environment; recommend and analyze feasible ways in which the project could be modified in order to eliminate or minimize adverse environmental impacts (if any); examine alternatives to the project itself; and complete all environmental review requirements necessary for the project’s compliance with applicable authorities.
MIG is qualified and experienced in utilizing industry standard screening and analytical techniques to determine the extent of environmental impact that may result from the project and applicable mitigation; therefore, staff is recommending the City Council approve amending MIG’s agreement to include environmental clearance services consistent with NEPA guidelines and requirements. MIG’s base bid total for NEPA services is $31,450. A 10 percent contingency of $3,145 is also included for a total amount of $34,595, bringing the total agreement not-to-exceed amount to $280,558.30.
