6.                     Discussion and Background

Description

The parking lot and pedestrian paseo closure request comes from the Orange Elks Lodge (Applicant) to host a beer tasting fundraising event.  From 6:00 a.m. to 6:00 p.m. on Saturday, September 28, the Applicant proposes to close the surface parking lot on Lemon Street adjacent to the Old Towne West Parking Structure and the adjoining paseo, as shown on the attached Special Event Permit Application and Area Map.

The event itself will take place between 12:00 p.m. and 4:00 p.m., with 500 people expected to participate. Details of the event, including logistics and health requirements, are also provided on the Special Event Permit Application.

Analysis

The affected parking lot has 25 marked public parking spaces.  The loss of parking is not expected to have a significant impact since the adjoining parking structure provides over 600 parking spaces, sufficient to serve both event guests and Old Towne visitors.  Additional parking is also available on the north side of Maple Avenue and on Cypress Street. The existing parking restrictions, including permit parking in residential areas, will remain in effect.  In addition, closing the paseo for such a short duration is also expected to have negligible impacts, simply requiring pedestrians to detour and use the north sidewalk on Chapman Avenue.

The Applicant has committed to providing staff and volunteers to control the flow of attendees entering and exiting the premises and to maintain a comfortable capacity within the area as well.

Special Event Permit

The request is for the closure of said parking lot and paseo only.  Concurrently, staff is administratively processing a companion Special Event Permit Application.  The special event application would be distributed to various City departments and divisions, including Police, Fire, Public Works Field Services, and City Attorney’s Office, to identify conditions of approval and any city resources deemed necessary to support the event.  The Applicant shall be responsible to pay the application fee and all associated charges for staff time.

In addition, the Applicant will be responsible to reimburse the City for Public Works staff to set up the necessary signs and barricades associated with the street closure.  The cost for this effort is approximately $1,224 and will be collected as part of the special event permitting process.  Moreover, the Applicant shall be responsible to ensure that all public facilities affected by the event are undamaged and sufficiently cleaned or restored to the satisfaction of the Public Works Department.  In case of non-compliance, the City reserves the right to perform cleaning and restoration at the Applicant’s expense and deny future requests for use of public facilities.

The parking lot and paseo closure, if approved, would (1) only apply to this event, and (2) be contingent on a Special Event Permit also being approved by staff.  If a Special Event Permit is not issued for any reason, the approval to close City facilities would automatically be rescinded.
