The eligible joint allocation amount awarded to the County of Orange is $365,643, of which $13,006 is allocated to the City of Orange. The County of Orange is requesting approval of an agreement that allocates the City’s 2020 program funds as follows: $1,300.60 for grant administrative fees, $351.16 for the National Incident-Based Reporting System, and $11,354.24 retained by the City.

1.                     Approve the agreement with the County of Orange in the amount of $11,354.24 for the 2020 Edward Byrne Memorial Justice Assistance Grant Program and authorize the City Manager to execute on behalf of the City.

2.                     Accept into the City’s revenue budget $11,354.24 in grant funds from the County of Orange, into revenue account number 353.4011.45150.30173, Federal Grants - JAG 2020.

3.                     Authorize the appropriation of $11,354.24 into expenditure account number 353.4011.55131.30173, Equipment - JAG 2020.

6.                     Discussion and Background

The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary provider of federal criminal justice funding to states and units of local government. In September 2020, the U.S. Department of Justice approved the application for funding under the 2020 Edward Byrne Memorial JAG Program. The joint allocation amount awarded to the County of Orange is $365,643, of which $13,006 was awarded to the City of Orange Police Department to support less than lethal munitions.

Over the past several years, the Orange Police Department has been involved in large-scale critical incidents that have required the rapid deployment of resources. These types of incidents present many challenges and can have dire consequences if not properly managed. The JAG program provides critical funding that enhances the department’s ability to manage these incidents and provides officers with the necessary equipment to be successful. The Orange Police Department’s 2020 jurisdictional project identified the need for less than lethal munitions, including tactical launchers and projectiles for the Police Department’s Special Weapons and Tactics team. Equipment will be used to expand less than lethal equipment inventory and will assist the department in obtaining a desired outcome while keeping the community safe.   

JAG Program award amounts are based on crime data collected through the Uniform Crime Reporting Program’s traditional Summary Reporting System which was recently replaced with the National Incident-Based Reporting System (NIBRS). As a condition of the award, the Bureau of Justice Assistance required award recipients to contribute three percent to NIBRS set-aside. JAG recipients must ensure that three percent of the award amount (less administrative fees) is used towards achieving NIBRS compliance, unless certified as NIBRS compliant by the Federal Bureau of Investigations.

The County of Orange is requesting approval of an agreement that allocates the City’s 2020 JAG funds as follows: $1,300.60 for grant administrative fees, $351.16 for the National Incident-Based Reporting System (NIBRS) set-aside contribution, and $11,354.24 retained by the City.
