b: Provide and maintain infrastructure necessary to ensure the safety of the public.
Goal 3: Enhance and promote quality of life in the community

6. Discussion and Background
El Modena Park was constructed in the early 1970s and several amenities have been in need of repair in order to maintain a safe and functional park environment for patrons. The City Council approved the phased El Modena Area Renovation project (30048) several years ago, which included park irrigation improvements, installation of tot lot shade sails, and rubberized surfacing at the tot lot (all completed in Fiscal Year 2022-23).
The last phase of the project, the ball field netting project, includes installing foul ball netting around the existing baseball field to address safety concerns related to rogue foul balls. With the current backstop fencing being insufficient in stopping foul balls, this project will include a foul ball trajectory study and subsequent analysis as necessary to calculate netting height and span of the protective netting to provide adequate protection of adjacent homes, park users, street traffic, and parked cars. The project will also include demolition and removal of the existing backstop and provide a new safety netting system along the first and third baselines of the baseball field.
A Request for Proposal (RFP 23-24.10) was issued in September 2023 for the design and preparation of construction documents, plans, specifications, and cost estimates for the project. The City received one responsive and responsible proposal from Verde Design, Inc. (Verde). Staff reviewed the proposal and based on the firm’s experience, overall qualifications, record of success, and overall responsiveness to the RFP, staff deemed Verde qualified. Verde is also the design firm currently contracted by the City to provide architectural and engineering design services for the Hart Park Diamond 1 Field Improvements project.
Verde’s proposed cost for the project is $116,560 which includes a conceptual plan, geotechnical investigation, foul ball trajectory study, construction drawings, and estimate of probable construction costs. Including a 10% contingency of $11,656 for unanticipated expenses, the total not to exceed amount for the contract is $128,216. The cost for the design is included in Fiscal Year 2023-24 CIP through the El Modena Area Rennovation Project (30048) in the El Modena Park Facility (Cell Tower Fee) fund (512). It is anticipated that the design process will take approximately five to six months to complete. Once construction documents are completed, a Request For Bid will be issued for construction.
7. ENVIRONMENTAL REVIEW
Categorical Exemption: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15301 “Existing Facilities” Class 1 because the project involves the repair and maintenance of existing facilities with no expansion of existing use. The CEQA Notice of Exemption will be filed with the County Recorder’s Office upon Council’s approval of the plans and specifications.
