2.                     Summary

Bids for Community Development Block Grant Americans with Disabilities Act Bathroom Door Access at Main Library were received and opened on March 18, 2021. Four bidders responded to the notice Inviting Bids. The second apparent lowest bidder is RS Construction & Development, Inc. of Upland, CA in the amount of $32,720.

Approve the contract with RS Construction & Development, Inc. in the amount of $37,628, representing an original bid amount of $32,720, plus a 15% contingency of $4,908 for ADA bathroom door access at the Main Library; and authorize the Mayor and City Clerk to execute on behalf of the City.

4.                     Fiscal Impact

The total expenditure for this contract is $37,628 and will be funded in Library Restrooms Accessibility (30136) through Community Development Block Grant (310).

6.                     Discussion and Background

This project will provide for the accessibility improvement of four Americans with Disabilities Act (ADA) bathroom door access at Main Library. As part of this project, actuator devices will be installed along with a mechanical door opener to allow the door to be opened with ease.

The informal bid solicitation was advertised on January 28, 2021 and February 18, 2021 and bids were opened on March 18, 2021. Four bids were received as follows:

1.                     Thomas Solar Energy, Westminster                                                               $  3,552.00*

2.                     RS Construction & Development, Inc., Ontario                                          $32,720.00

3.                     R Dependable Construction, Inc., San Bernardino                     $38,400.00

4.                     Star 1 MS, Inc., Jurupa Valley                                                                                    $38,926.40

*Bidder rescinded their bid.

The City receives Community Development Block Grant (CDBG) funding from the U.S. Department of Housing and urban Development for activities that primarily benefit Low and Moderate Income residents. The funding source requires that a certain percentage of the work be awarded to Disadvantaged Business Enterprises (DBE). The bidder is required to submit the Construction Contract DBE Commitment form showing how they will meet the project DBE goal, or submit the DBE information Good Faith Effort (GFE) form, documenting that adequate good faith efforts were made. Upon review of the bid received from the apparent low bidder, RS Construction & Development, Inc. has provided documentation showing its GFE.

The first apparent low bidder Thomas Solar Energy of Westminster filed a bid error.   Staff reviewed the error and accepted the bid withdraw.   The second low bid received is 31.9% lower than the Engineer’s Estimate. Staff checked the references and qualifications for RS Construction & Development, Inc. and found them to be acceptable, with adequate years of experience in completing contracts of similar nature to this project. Therefore, staff recommends that RS Construction & Development, Inc. be awarded the contract in the total amount of $37,628, representing an original amount of $32,720, plus a contingency of $4,908, for the Community Development Block Grant Americans with Disabilities Act Bathroom Door Access at Main Library.

Construction is scheduled to begin in May 2021 and expected to be completed within 30 calendar days.
