6. Discussion and Background
On May 5, 1992, the City of Orange (City) and the California Department of Transportation (Caltrans) entered into a Freeway Maintenance Agreement establishing their respective maintenance responsibilities along State Route 57 (SR-57).
An update to the current agreement was prompted by the City of Anaheim’s bridge-widening project on Orangewood Avenue. Although the bridge is owned by the City of Orange, the City of Anaheim is responsible for performing the construction work. Because the proposed improvements extend into the SR-57 underpass area, an updated Freeway Maintenance Agreement is required. This agreement does not require any additional budget appropriation. The maintenance responsibilities outlined in the agreement for the Chapman Avenue and Orangewood Avenue undercrossings (such as roadway surfaces, sidewalks, street lighting, drainage, and graffiti removal) are primarily existing obligations continued from the 1992 Freeway Maintenance Agreement. Minor incremental maintenance obligations resulting from the widened bridge footprint and relocated City utility encroachments on Orangewood Avenue (including a 16-inch water main, storm drain facilities, and streetlight conduits) will result in negligible additional costs.
Accordingly, the City and Caltrans have mutually agreed to supersede the 1992 agreement with a new agreement that clearly defines and delineates their respective maintenance responsibilities for State Highway System facilities along the SR-57 corridor.
The proposed Freeway Maintenance Agreement establishes the respective maintenance obligations of the City and Caltrans for various facilities within the State right-of-way, including, but not limited to, the following:
• Overcrossings and Undercrossings - Caltrans will be responsible for inspecting and maintaining the structural components of the crossings at its expense. The City will be responsible for the maintenance, inspection, and repair of city owned bridge decks, roadway surfaces, structural drainage facilities, lighting, sidewalks, and graffiti removal.
• Walls and Columns - The City will be responsible for removing debris, trash, and graffiti, as well as cleaning and painting walls and soundwalls on surfaces facing City streets.
• Bicycle and Pedestrian Paths - The City will be responsible for maintaining bicycle and pedestrian paths and associated facilities within its jurisdiction, including pavement, structural components, sweeping, and graffiti removal.
• Landscaped Areas - City will be responsible for maintaining landscaping, plants, and other roadside improvements installed and owned by the City within the State right-of-way.
• Unsheltered Encampments - Caltrans will be responsible for removing unsheltered encampments and associated debris within their respective areas of maintenance responsibility, in accordance with applicable state and federal laws.
