2. SUMMARY
The proposed ordinance amends the Orange Municipal Code to bring the City's regulations regarding Homeless Shelters (Emergency Shelters) and Low Barrier Navigation Centers into compliance with State law, specifically Government Code Sections 65583(a)(4) and 65660 through 65663. The amendments update definitions, revise development and operational standards for homeless shelters, establish standards for Low Barrier Navigation Centers, and amend land use and parking regulations to ensure consistency with State law.
On July 20, 2026, the Planning Commission continued this item to the September 10, 2026, Planning Commission meeting to allow additional time for staff to provide information requested by the Planning Commission prior to making a recommendation to the City Council.
Following the July 20, 2026 meeting, a notice of continuance was not posted within 24 hours as provided by Government Code Sections 54955 and 54955.1. Accordingly, staff intends to provide a new notice of public hearing for the ordinance to ensure compliance with all applicable public noticing requirements.
Because the proposed Zoning Ordinance Amendment affects the permitted uses of real property, Government Code Section 65854(b)(2) requires public notice to be provided at least 20 days prior to the hearing. The October 19, 2026, Planning Commission meeting provides sufficient time for the City to publish the required notice and complete the applicable noticing period.
