6. Discussion and Background
The co-trustees at 1983 North Agate Street, Wayne Joseph Vandal and Mercedita C. Vandal, have requested the vacation of the six-foot wide City easement on the north side of the property due to the collapsed condition of the existing storm drain. Co-trustees claim the storm drain is in poor condition, not used, and does not serve a purpose. Co-trustees are requesting the City to vacate the easement to allow for a future accessory dwelling unit. City inspection and assessment conducted confirmed that the storm drain is no longer functional and does not serve its intended purpose.
Given that the storm drain is no longer needed, staff recommends approval of the Quitclaim Deed of the storm drain easement to The Moving On Family Trust dated 11-17-2022, Wayne Joseph Vandal and Mercedita C. Vandal as Co-trustees at 1983 North Agate Street and authorize the Mayor to sign the Quitclaim Deed.
