2.                     Summary

The U.S. Department of Justice has determined that each city receive their own three percent National Incident-Based Reporting System (NIBRS) set-aside allocation, previously administered by the County of Orange, for use on NIBRS activity. The amounts being redistributed back to the City are $602.70 and $351.16 for Fiscal Years 2018-2019 and 2019-2020, respectively.

6.                     Discussion and Background

The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary provider of federal criminal justice funding to states and units of local government.

In September 2021, the County of Orange notified all participating cities that the three percent National Incident-Based Reporting System (NIBRS) set-aside allocation, previously administered by the County of Orange, be redistributed back to each city. Since 2018, the County of Orange has set aside three percent of JAG funds for NIBRS compliance. For Fiscal Year 2017-2018, the County, as the Fiscal Agent, utilized the funds to pay for the NIBRS training available to the County and city sub-recipients. For the following grant years, the U.S. Department of Justice requested that each city receive their own allocation for use towards NIBRS compliance.

The amount being redistributed back to the City of Orange for Fiscal Year 2018-2019 (FY19) is $602.70   and for Fiscal Year 2019-2020 (FY20) is $351.16. When the additional $602.70 and $351.16 are appropriated, the total available funding for FY19 is $18,683.70 and FY20 is $11,705.40. The three percent NIBRS set-aside allocation may be used towards NIBRS compliance, including software, hardware, and labor that directly support or enhance the department’s capacity for collecting, processing and analyzing data.
